The Good Home acts exclusively as an intermediary and/or coordinator and cannot be held responsible, in any capacity whatsoever, for the failure, insolvency, bankruptcy, cessation of activity, professional misconduct, breach of contract or non-compliance with applicable legal and regulatory provisions by any supplier, contractor or subcontractor involved in the performance of the services.
The aforementioned parties act independently and under their sole responsibility, the Client expressly waiving any right to hold The Good Home jointly and severally liable for any direct or indirect consequences resulting from their acts, omissions or failures.
The ten-year warranty only applies to the contractor who carried out the work.
The absence of a written objection within 8 days constitutes final acceptance.
No payment withholding can be unilaterally imposed.
All deposits are non-refundable.
Once the work has been completed, no amount can be withheld for subjective reasons.
Any unpaid invoice will result in:
Management fees are set at 15% excluding VAT of the gross monthly rent for all rentals of more than three months, 20% excluding VAT for all rentals of less than three months, one month's rent excluding VAT for all rentals of more than one year.
They cover:
The fees remain due even in the event of a dispute between the landlord and the tenant.
The Good Home is not responsible:
The owner assumes the obligation to provide insurance.
The landlord is solely responsible for establishing a tenant's address.
The Good Home declines all tax, social or administrative responsibility.
Planning permission is the responsibility of the property owner.
Any administrative fine remains his responsibility.
The Good Home is not responsible:
It acts solely as a transmission intermediary.
No responsibility for:
Even in the event of a building safety defect.
Includes, in particular:
Automatic suspension of obligations without compensation.
The Good Home can terminate immediately in the event of:
Without compensation.
Any offer, quote, budget proposal or estimate submitted by The Good Home is:
Unless expressly stated in writing “fixed and final package”, the amounts communicated constitute evolving budget estimates.
The Good Home assumes no obligation to achieve a specific financial result.
Prices may vary due to factors including:
The client expressly acknowledges that the building and development sector is subject to unpredictable variations.
No liability can be incurred for exceeding the estimate.
The work and improvements are billed on the following basis:
A detailed accounting is prepared at the end of the mission.
The customer agrees that:
No estimate can be interpreted as a fixed price.
Even if it mentions “estimated total budget”, this does not constitute a firm commitment.
Only the explicit mention “fixed non-revisable fixed price” signed by both parties can create a fixed obligation.
Any additional work necessary for proper execution is deemed accepted when:
The absence of immediate objection constitutes acceptance.
The Good Home is bound by an obligation of means.
It does not guarantee:
Failure to submit a written objection within 8 days of receipt:
constitutes final acceptance.
No unilateral detention may be carried out.
All payments are due even in the event of a subsequent disagreement.
The customer retains the right to file a separate claim, without suspending payment.
In case of non-payment:
The Good Home cannot be reclassified:
She acts exclusively as a coordinator/intermediary/project manager.
The client will indemnify The Good Home against any third-party claims related to:
Any abusive procedure or attempt at intimidation will result in a fixed penalty of €5,000.
