CHAPTER I – STATUS & ABSENCE OF JOINT LIABILITY

ARTICLE 1 – IDENTITY & PROFESSIONAL STATUS

The Good Home SRL is a company incorporated under Belgian law, an IPI-approved real estate agency, acting exclusively:

  • in the capacity of a real estate intermediary
  • property manager
  • of works coordinator
  • of the owner's representative
  • project management
  • interior design

The Good Home does not own any property unless expressly stated.
She assumes no obligations specific to the owner.

ARTICLE 2 – PURPOSE OF THE CONTRACT

These conditions apply to:

  • Rental management (short, medium, long term)
  • work coordination
  • interior design
  • subcontracting
  • administrative management

Any signature of a quote, mandate or contract implies unconditional acceptance.

ARTICLE 3 – LACK OF SOLIDARITY

The Good Home acts as an independent intermediary.
She cannot be held jointly liable:

  • actions of an owner
  • actions of a tenant
  • actions of an entrepreneur
  • actions of a supplier
  • administrative decisions

ARTICLE 4 – GLOBAL LIMITATION OF LIABILITY

The Good Home's total liability is strictly limited to the amount of fees actually received during the last 6 months.

The following are expressly excluded:

  • indirect losses
  • lost revenue
  • rental loss
    loss of earnings
  • moral damage
  • commercial damage
  • image loss
  • third-party claims

No responsibility can be assumed for an event beyond its control.

ARTICLE 5 – SUBCONTRACTING

The Good Home is free to use any subcontractor.
The subcontractors operate in complete independence.

The Good Home:

  • is not responsible for technical errors
  • is not responsible for structural defects
  • assumes no technical guarantee
  • cannot be considered a builder

The Good Home acts exclusively as an intermediary and/or coordinator and cannot be held responsible, in any capacity whatsoever, for the failure, insolvency, bankruptcy, cessation of activity, professional misconduct, breach of contract or non-compliance with applicable legal and regulatory provisions by any supplier, contractor or subcontractor involved in the performance of the services.

The aforementioned parties act independently and under their sole responsibility, the Client expressly waiving any right to hold The Good Home jointly and severally liable for any direct or indirect consequences resulting from their acts, omissions or failures.

The ten-year warranty only applies to the contractor who carried out the work.

ARTICLE 6 – ACCEPTANCE OF WORKS

The absence of a written objection within 8 days constitutes final acceptance.
No payment withholding can be unilaterally imposed.

ARTICLE 7 – IRREVOCABILITY OF PAYMENTS

All deposits are non-refundable.
Once the work has been completed, no amount can be withheld for subjective reasons.
Any unpaid invoice will result in:

  • legal interest plus 10 %
  • penalty clause of 15 %
  • minimum flat rate of €750

ARTICLE 8 – RENTAL MANAGEMENT

Management fees are set at 15% excluding VAT of the gross monthly rent for all rentals of more than three months, 20% excluding VAT for all rentals of less than three months, one month's rent excluding VAT for all rentals of more than one year.

They cover:

  • looking for a tenant
  • administrative follow-up
  • cash collection
  • coordination
  • day-to-day management

The fees remain due even in the event of a dispute between the landlord and the tenant.

ARTICLE 9 – RENTAL LIABILITY

The Good Home is not responsible:

  • unpaid bills
  • deterioration
  • flights
  • squatters
  • illegal occupations
  • neighborhood disputes

The owner assumes the obligation to provide insurance.

ARTICLE 10 – DOMICILIATION

The landlord is solely responsible for establishing a tenant's address.
The Good Home declines all tax, social or administrative responsibility.

ARTICLE 11 – TOURIST DESTINATION

Planning permission is the responsibility of the property owner.
Any administrative fine remains his responsibility.

ARTICLE 12 – FAILURES & NETWORKS

The Good Home is not responsible:

  • gas outage
  • water outage
  • power outage
  • Internet outage
  • Supplier failure

It acts solely as a transmission intermediary.

ARTICLE 13 – THEFT & CRIME

No responsibility for:

  • flight
  • burglary
  • vandalism
  • cybercrime
  • illegal occupation

Even in the event of a building safety defect.

ARTICLE 14 – FORCE MAJEURE

Includes, in particular:

  • strike
  • pandemic
  • fire
  • disaster
  • administrative decision
  • supplier delay

Automatic suspension of obligations without compensation.

 

ARTICLE 15 – UNILATERAL TERMINATION

The Good Home can terminate immediately in the event of:

  • non-payment
  • abusive behavior
  • attempted fraud
  • false statement
  • damage to his image

Without compensation.

CHAPTER II – OFFERS, QUOTES & WORKS

ARTICLE 1 – NATURE OF OFFERS & ESTIMATES

Any offer, quote, budget proposal or estimate submitted by The Good Home is:

  • purely indicative
  • non-fixed price
  • not final
  • based on information
  • available at the time of its establishment

Unless expressly stated in writing “fixed and final package”, the amounts communicated constitute evolving budget estimates.

The Good Home assumes no obligation to achieve a specific financial result.

 

ARTICLE 2 – PRICE VARIATIONS & FLUCTUATIONS

Prices may vary due to factors including:

  • fluctuation of raw materials, VAT modification
  • out of stock
  • technical adaptation during construction
  • evolution of standards
  • architectural adaptation
  • increased labor costs
  • supplier change
  • initial hardware error
  • adjustment necessary for proper execution

The client expressly acknowledges that the building and development sector is subject to unpredictable variations.
No liability can be incurred for exceeding the estimate.

 

ARTICLE 3 – ACCOUNTING BASED ON INVOICES

The work and improvements are billed on the following basis:

  • supplier invoices
  • subcontractor invoices
  • material invoices
  • transport invoices
  • labor invoices
  • accepted pro forma invoices
  • advance payments

A detailed accounting is prepared at the end of the mission.

The customer agrees that:

  • pro forma invoices form the basis for invoicing
  • The adjustments are incorporated into the final count
  • administrative rounding should be allowed

 

ARTICLE 4 – NO IMPLIED PACKAGE

No estimate can be interpreted as a fixed price.
Even if it mentions “estimated total budget”, this does not constitute a firm commitment.
Only the explicit mention “fixed non-revisable fixed price” signed by both parties can create a fixed obligation.

 

ARTICLE 5 – ADDITIONAL WORK

Any additional work necessary for proper execution is deemed accepted when:

  • it stems from a technical constraint
  • It is imposed by the reality of the construction site
  • it is validated verbally or by message
  • it is essential for compliance

The absence of immediate objection constitutes acceptance.

 

ARTICLE 6 – NO OBLIGATION OF BUDGETARY RESULTS

The Good Home is bound by an obligation of means.
It does not guarantee:

  • respecting an initial budget
  • the absence of an increase
  • maintaining supplier prices
  • the stability of economic conditions

 

ARTICLE 7 – TACTICAL ACCEPTANCE & SILENCE

Failure to submit a written objection within 8 days of receipt:

  • of a quote
  • of an adjustment
  • of a count
  • of an invoice

constitutes final acceptance.

 

ARTICLE 8 – PROHIBITION ON WITHHOLDING PAYMENTS

No unilateral detention may be carried out.
All payments are due even in the event of a subsequent disagreement.
The customer retains the right to file a separate claim, without suspending payment.

 

ARTICLE 9 – ENHANCED PENALTY CLAUSE

In case of non-payment:

  • legal interest + 12 %
  • penalty clause of 20 %
  • minimum €1,000
  • Lawyer fees are fully recoverable.

 

ARTICLE 10 – NON-REQUALIFICATION

The Good Home cannot be reclassified:

  • as a promoter
  • as a builder
  • as main contractor
  • as the responsible project manager

She acts exclusively as a coordinator/intermediary/project manager.

 

ARTICLE 11 – FULL COMPENSATION

The client will indemnify The Good Home against any third-party claims related to:

  • at the construction site
  • to aesthetic choices
  • to budgetary decisions
  • to administrative authorizations
  • to urban planning standards

 

ARTICLE 12 – ANTI-ABUSE CLAUSE

Any abusive procedure or attempt at intimidation will result in a fixed penalty of €5,000.
